MEMORANDUM AND ORDER
WALKER, District Judge:
Currently before the Court are defendants’ motions to dismiss the Amended Complaint on the grounds that the Racketeer Influenced and Corrupt Organizations Act (“RICO”) 1 claim not only fails to state claims upon which relief can be granted, Fed.R.Civ.P. 12(b)(6), but also fails to provide the particularity mandated by Rule 9(b) of the Federal Rules of Civil Procedure; and because the Court lacks subject matter jurisdiction over the remaining state law claims, Fed.R.Civ.P. 12(b)(1).
