FUNDERBURK, Justice.

By this suit G. E. Robinson and wife seek to recover damages from R. L. Draper and Republic Underwriters for the death of plaintiffs’ seven year old daughter, Mildred Ruth Robinson. The claim of liability is predicated, in part, on a certain bond of R. L. Draper as principal, and Republic Underwriters as surety. Damages in excess of the bond were claimed against R. L. Draper on the ground of negligence.
