AMENDED MEMORANDUM OPINION

TILLEY, Chief Judge.

Plaintiff Syngenta Corp Protection, Inc. (“Syngenta”), filed suit against Defendant United States Environmental Protection Agency (“EPA”) for violation of the Federal Insecticide, Fungicide, and Rodenticide Act (“FIFRA”). 7 U.S.C. §§ 136 et seq. (1999). This case is before the Court on Syngenta’s Motion for a Preliminary Injunction [Doc. # 3] and request for a stay pending appeal. For the reasons set forth below, Plaintiffs motion is DENIED.
