This is an action in the nature of (pao warranto, *502brought on the information of the district attorney of Yankton county, to oust the defendants, Robert Cox, Miles T. Woolley, W. Y- Quigley and F. A. Gale, from the office of trustees of the insane asylum located at Yankton, Dakota.

The defendants answer separately, and the plaintiff demurs to the answers of the defendants Cox and Woolley, which raises the questions of law presented to the court for determination.
