Introduction

Petitioners, the State of California and Williams Construction Company, defendants in a civil action (hereinafter defendants) seek a writ of mandate to compel the superior court to vacate its order denying a motion to dismiss for failure to bring the action to trial within five years pursuant to Code of Civil Procedure section 583, subdivision (b) (hereinafter section 583(b)) and to enter in lieu thereof an order granting said motion.
