The City of Evanston notified Northern Illinois Gas Company (“Nicor”) and Commonwealth Edison (“ComEd”) in October 2014 of its intent to sue the companies under the Resource Conservation and Recovery Act (“RCRA”), 42 U.S.C. § 6901 et seq., for improper disposal of “solid waste.” In,response, Nicor preemptively filed suit, requesting a declaratory judgment that the company has no liability to the City under RCRA.
