{¶ 1} Defendant-appellant, Randall Asberry, was indicted by a Cuyahoga County Grand Jury in June 2005 on two counts of escape in violation of R.C. 2921.34, a felony of the second degree. The indictment resulted from appellant’s failure to timely report to his parole officer. On September 9, 2005, appellant appeared before the court and withdrew his previously entered plea of not guilty, and, pursuant to a plea agreement, he entered a plea of guilty to one count of escape.
