OPINION
WIESE, Judge.
This case is before the court on defendant’s motion to dismiss for lack of jurisdiction and, alternatively, on the parties’ cross-motions for summary judgment. The issue is whether plaintiff, a Miller Act surety, is entitled to invoke the doctrine of equitable subrogation to recover from the Government the amount of contract proceeds that were paid over to plaintiffs insured (the contractor) after (i) the Government was made aware of plaintiffs competing interest in those funds, and (ii) the contract had been completed to the Government’s satisfaction.
