This surety case stems from a contract entered between the United States Coast Guard (“Coast Guard”) and Eagle Management Enterprises, Inc. (“Eagle”) for the purpose of renovating the federally-owned Coney Island Light Tower in Brooklyn, New York. At the request of Eagle, the plaintiff, Nova Casualty Company (“Nova”), issued performance and payment bonds for the benefit of the United States as obligee.
