James Lund, an employee of the Defense Communications Agency, was indicted on three counts of violating the federal conflict-of-interest statute, 18 U.S.C. § 208(a), based on his alleged participation in three intra-agency personnel decisions in which his wife, who was one of his subordinates, had a financial interest. The district court dismissed the indictment on the ground that § 208(a) did not apply to conflicts of interest in intra-agency personnel matters.
