Robert Harris was indicted for the offense of rape alleged to have been committed upon the person of Cora Lee Brown. The jury returned a verdict of guilty, with the recom*407mendation that the punishment be a minimum of ten years and a maximum sentence of ten years; and the accused was sentenced accordingly. The defendant made a motion for new trial, which was overruled, and he excepted.
