Defendants move under subdivision 5 of rule 10.7 of the Rules of Civil Practice, to dismiss the complaint, which seeks to enjoin them from using the name “ Overseas ”, upon the ground that there is an existing final decree rendered on the merits determining the same cause of action between the parties.
