The action is tort for personal injuries received in an automobile accident, and the case is here on plaintiff’s exceptions. At the time of the accident, and for some days before, the parties together with, several others were employed on a highway construction job hauling gravel in auto-trucks. At the place where the accident occurred the highway runs north and south, descends to the south, and is very winding.
