Appeal, by permission, by the plaintiff, Charles Pache, from an order of the Appellate Term of the Supreme Court, entered in the office of the clerk of said court on the 23d day of November, 1903, which order affirmed a judgment of the Municipal Court of the city of New York, borough of Manhattan, in favor of the defendant, ' entered on the 9th day of May, 1903, sustaining the defendant’s demurrer to the plaintiff’s complaint and dismissing the said complaint.

This action was brought in the Municipal Court of the city of New York and the plaintiff alleged in his complaint that Eliza Pache died at the city and county of New York on the 26th day of February, 1902; that he was her husband;'that the defendant is the executrix of the estate of his deceased wife and duly qualified as such executrix; that his wife died, leaving, property sufficient and ample to satisfy and pay all her debts and funeral expenses; and that one Stolzenberger, an undertaker, took charge .of - the funeral arrangements and performed certain services in connection…
