The plaintiff is suing to recover from the defendants the expenses of hospitalization which the Fordham Hospital rendered to an infant injured by the negligence of the defendant Mendelson. The defendant Red Cab Mutual Casualty Co., Inc., is an insurance carrier which has insured the defendant Mendelson against his liability for the infant’s injuries. Plaintiff has duly served and filed notices of his “ lien ” upon both of the defendants.
