This is an apjreal from a determination of the Appellate Term affirming a judgment of the Municipal Court sustaining a demurrer to the complaint. The plaintiff, as trustee in bankruptcy of theestate of John T. Lee, brought an action in the Municipal Court of the city of Mew York against the defendant wherein-he alleged that within four months prior to the filing of the petition in bankruptcy, the Consolidated Stock and.
