This is an action of tort for personal injuries sustained by reason of an alleged defective condition of a *268cross walk at the junction of Chatham Street and Commercial Street in the city of Boston. It was admitted by the defendant that due and sufficient notice of the time, place and cause of the injuries claimed to have been received by the plaintiff was given the defendant. At the close of all the evidence the defendant moved that a verdict be directed upon grounds set forth in the defendant’s motion.
