This is an action of tort to recover damages assessed by way of penalty under G. L. c. 229, § 1, for the death of the plaintiff’s intestate alleged to have been caused while he was a traveller on a public way by a defect, or want of repair, or a lack of a sufficient railing on a. public way, and by failure properly to light the same.
