OPINION
ORLOFSKY, District Judge:
Presently before the Court is the motion of Defendant, Caine, DiPasqua, Sloane & Raffa-ele, for summary judgment. Caine, DiPas-qua essentially challenges the ability of Plaintiff, RTC Mortgage Trust 1994 N-l, to prosecute its claim for negligent misrepresentation or legal malpractice. This appears to present an issue of first impression in this district, namely whether provisions of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (“FIRREA”) preempt the well-settled principle of New Jersey law that tort claims are not assignable prior to…
