MEMORANDUM OPINION AND ORDER

GETTLEMAN, District Judge.

Plaintiffs Thomas Dunn (“Dunn”) and Denny Robinson (“Robinson”), individually and on behalf of all others similarly situated, filed a four-count putative class action against defendant City of Chicago (“City”) pursuant to *37042 U.S.C. § 1983 on October 21,2004.
