Plaintiff in error, Arkansas Valley Town & Land Company, brought suit in the trial court against defendant in error, Atchison, Topeka &■ Santa Fe Railway Company, for damages. The parties will be referred to as they were in the trial court. Defendant filed demurrer to the petition, which was sustained, and plaintiff brings error.
