Plaintiff brought this action for damages for the loss of an eye alleged to have been caused by the negligence of defendants. The jury, by a 10 to 2 vote, brought in a verdict for defendants. Plaintiff appeals from the judg ment and from the order denying his motion for a new trial. In civil cases the order denying a motion for a new trial is not independently appealable, bnt is reviewable on the appeal from the'judgment. The independent appeal from such order must therefore be dismissed.
