1Opinion of the CourtM. J. Kelly, J.

In this appeal we are asked to review the potential liability of defendants-appellees Wilford and Virginia Mielke, whose alleged negligence in forcing the plaintiff, while intoxicated, to leave their home and attempt to drive his automobile was said to have caused an accident and subsequent injuries to the plaintiff. The trial court granted defendants’ motion for summary judgment on the basis that plaintiff had failed to state a claim upon which relief could be granted, GCR 1963, 117.20L). * 1 The facts in this case thus consist of the pleadings filed by the parties.
