OPINION
FRYE, District Judge:
The matter before the court is the motion of defendants Todd David Mehlbrech and Lois Ann Jubb for summary judgment (# 39).
BACKGROUND
On November 22, 1994, this court granted the motions of the plaintiff, Prudential Insurance Company of America, for interpleader and for summary judgment on the counterclaim of defendant Gloria G. Mehlbrech for breach of contract.
