OPINION

GOLDBERG, Justice.

This case came before the Supreme Court on November 3, 2004, on appeal from a Superior Court order granting a new trial to the defendants, Eugene Hastings (Eugene) and Phyllis Hastings (Phyllis or, collectively, defendants), eo-execu-tors and sole heirs of the estate of James Pollard (James or decedent), late of Tiver-ton, Rhode Island. The plaintiff, Raymond F. Pollard (Raymond or plaintiff), the decedent’s brother, contested the will and seeks reinstatement of the jury finding that the decedent lacked testamentary capacity to execute a will.
