The appellants were sureties to the plaintiff for one Mooney, its agent, and the conditions on -which their obligation depended were, 1st, that Mooney should perform his contract with the plaintiff; 2d, that he should faithfully discharge his duties as agent; and 3d, that he should pay over all moneys belonging to it in such manner as should be prescribed.
