This suit was instituted by ap-pellee, Francis, as administrator of the estate of Porter Francis, deceased, against the Atchison, Topeka & Santa Fé Railway Company, the Panhandle & Santa Fé Railway Company, and Walker D. Hines, agent, appointed by the President of the United States, to recover damages on account of the death of Porter Francis, son of the plaintiff, which occurred as a result of an accident at the shops of the Atchison, Topeka & Santa Fé Railway Company, at Clovis, N.
