Appeal from District Court, Potter County; Henry S. Bishop, Judge. Action by John Hawley against the Port Worth' & Denver City Railway Company. Judgment for plaintiff, and defendant appeals.

John Hawley, for himself and for his wife, Mertie Hawley, sued appellant railway company for damages occasioned by the death of B. E. Mathews, alleged to have been caused by the negligence of appellant. R. E. Mathews was the son of Mrs. Mertie Hawley by a former husband and the stepson of John Hawley. At the time of his death, July 24, 1920, he was about IS years old. On the 23d of July it is alleged that when he received the injuries from which he died he was a passenger on appellant’s train, .in charge of ten head of horses, being transported in a freight train over appellant’s line of road…
