This matter is before the Court on cross-motions for judgment on the pleadings. (Doc. Nos. 37, 43) The motions are fully briefed and ready for disposition.

Background

This action arises out of a cyber attack on grocery store chain Schnuck Markets, Inc. (“Schnucks”) in late 2012 through early 2013 which compromised certain of its customers’ debit and credit card information.
