Appeal from a judgment of the County Court of Otsego County (Burns, J.), rendered June 14, 2013, convicting defendant upon his plea of guilty of the crime of criminal sale of a controlled substance in the third degree.

In satisfaction of a two-count indictment, defendant pleaded guilty to criminal sale of a controlled substance in the third degree and purportedly waived his right to appeal. The plea agreement contemplated that defendant would be sentenced, as a second felony offender, to 4V2 years in prison to be followed by two years of postrelease supervision.
