BRUGGINK, Judge.
This is an action for back pay brought pursuant to Article III of the United States Constitution. The matter is pending on remand from the United States Court of Appeals for the Federal Circuit. Beer v. United States, 696 F.3d 1174 (Fed.Cir.2012), cert. denied, — U.S. -, 133 S.Ct. 1997, 185 L.Ed.2d 866 (2013).
