The claimant appellant filed with the commissioner of industries on October 22, 1934, a notice of injury and claim for compensation, in writing, dated October 20, 1934, wherein he stated in substance that he had been injured by accident arising out of and in the course of his employment by the defendant Parks and Woolson Machine Company on the. 24th day of February, 1928, and demanded compensation under the Workmen’s Compensation Law for said injuries.
