The plaintiff in error, hereinafter called the defendant, was convicted in the county court of Oklahoma county on a charge of possession of intoxicating liquor, to wit, 20 gallons of wine, a substance containing more than one-half of 1 per cent, of alcohol capable of being used as a beverage, and his punishment fixed at a fine of $50 and confinement in the county jail for a period of 30 days.
