Appeal by the defendant, The Mayor, Aldermen and Commonalty of the City of New York, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the ,18th day of March, 1898, upon the •verdict of a jury rendered by direction of the court.

O’Brien, J.:

This is an action brought to recover the amount of taxes which the plaintiff paid on property in Barclay street, New York city, for the year 1894. In January, 1890, proceedings for opening and widening College place, between Chambers and Greenwich streets, were begun, and one of the properties condemned was the .one in question, then owned by the plaintiff. The report of the commissioners was confirmed on May 8, 1894. In September,-1894, the taxes for that year were confirmed. In December, 1894, the plaintiff paid the taxes on the property, and on January 4, 1895, he demanded back…
