DECISION AND ORDER

The parties are before the court on the plaintiffs complaint to determine the dis-chargeability of debt. The plaintiff in the above captioned proceeding filed a motion for summary judgment pursuant to 11 U.S.C. § 523(a)(4) & (a)(6) 1 . The parties were scheduled to appear before the court on January 11, 2005 to give oral argument on the motion for summary judgment, but instead submitted the motion for decision on their filed briefs.
