This cause came on to be heard on the evidence, argument of counsel, and memoranda submitted by both parties. The court finds the facts are as follows:
On February 4,1982, at 12:45 a.m., at the Pizza Hut restaurant on Plainfield Road in Blue Ash, Hamilton County, Ohio, Officer Robert Stewart of the Blue Ash Police Department was summoned by a police radio to investigate a report of a person in a vehicle “sleeping or sick.” Upon the officer’s arrival, he found the keys in the ignition, the motor running, and the defendant as the only occupant of a small truck.
