This appeal arises from an order of the circuit court granting plaintiff Alon Kim’s motion for summary judgment on the basis that the forfeiture agreement contained in the capital accumulation plan violated the Illinois Wage Act (820 ILCS 115/1 et seq. (West 2002)). That order also denied defendants’ cross-motion for summary judgment, denied plaintiffs claim for prejudgment interest and attorney fees, denied defendants’ motion for rescission of the entire plan, and denied defendants’ motion for summary judgment on the counterclaim.
