This matter came before the Court for hearing on the second “Motion of HomEq for Relief from Stay” [docket # 31] to pursue an action to evict the Debtor from property located at 23 Sigel Street, Worcester, Massachusetts (the “Property”). As with its previous unsuccessful motion for relief [docket # 10], HomEq Servicing Corporation (“HomEq”) claims that a proper foreclosure sale was conducted prior to the commencement of the Debtor’s bankruptcy.
