This matter comes before the court on plaintiffs request for injunctive and declaratory relief. Plaintiff, Richard Penta (“Penta”), asks the court to declare invalid the recount of a municipal election in the City of Revere for the office of City Councillor from Ward 1, to order that a Certificate of Election be issued to Penta, or, in the alternative, to order a new election.
