This cause is here on appeal on questions of law from a judgment in favor of the defendant railroad entered upon a verdict of the jury directed by the Common Pleas Court at the conclusion of plaintiff’s evidence upon the ground that the evidence adduced disclosed that plaintiff’s decedent was guilty of negligence as a matter of law proximately contributing to his injury and death. The principal error assigned is that the trial court erred in directing the verdict for the defendant.
