OPINION
{¶ 1} Defendant-appellant, Joseph P. Phipps, appeals the denial of his Motion to Suppress by the Portage County Municipal Court, Kent Division. For the following reasons, we affirm the decision of the court below.
{¶ 2} On October 2, 2005, Phipps was issued a traffic citation by Highway Patrol Trooper, Seth Howard, for Operating a Vehicle Under the Influence of Alcohol, a misdemeanor of the first degree in violation of R.C. 4511.19(A)(1)(a). On October 4, 2005, Phipps entered a plea of not guilty to the charge.
