MEMORANDUM OPINION AND ORDER
BABCOCK, District Judge.
In this diversity action, plaintiff, UMLIC-Nine Corporation (UMLIC) moves for summary judgment seeking judgment in rem against property located in Eagle County Colorado in the principal amount of $250,-000.00 plus interest, attorney’s fees and costs, an order directing the U.S. Marshal to sell the property at public sale, and application of the proceeds to their judgment.
