— In Rutherford v. Owens-Illinois, Inc. (1997) 16 Cal.4th 953 [67 Cal.Rptr.2d 16, 941 P.2d 1203] (Rutherford), the California Supreme Court addressed the burden on a plaintiff in an asbestos-related cancer case to prove that the defendant’s product was a legal cause of the plaintiff’s (or the plaintiff’s decedent’s) injuries.
