Appeal from a judgment of the Supreme Court, Erie County (John A. Michalek, J.), entered September 3, 2004 in a personal injury action. The judgment, upon a jury verdict, awarded plaintiff $1,500,000, together with interest, costs and disbursements.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously modified on the law by granting the posttrial motion and setting aside the award of damages and as modified the judgment is affirmed without costs, and a new trial is granted on damages only unless plaintiff, within 20 days of service of a copy of the…
