*1274Appeal from an order of the Supreme Court, Onondaga County (Edward D. Garni, J.), entered August 31, 2005. The order, insofar as appealed from, denied those parts of defendants’ motion for partial summary judgment dismissing all causes of action under Public Health Law § 2801-d and all claims or causes of action based on the Omnibus Budget Reconciliation Act of 1987 and all claims for punitive damages.
