Appeal from an order of the Family Court of Warren County (Breen, J.), entered August 13, 2008, which, in a proceeding pursuant to Family Ct Act article 3, granted respondent’s motion to suppress certain evidence.

At approximately noon on July 19, 2008, the three-year-old victim was found wandering alone on Route 9 in the Town of Queensbury, Warren County. She was visibly dirty and disheveled, with bruises, cuts and other injuries.
