Taylor, J.:

Antonia E. Sanchez, the relator, in the suit in the Circuit Court of St. Johns county, against John Lott Phillips, as executor of John Lott Philips, deceased, that was tried' before a referee, recovered judgment for $540, besides costs. Phillips, the defendant executor, took writ of error to this court, and the cause was decided here at the January term, 1895 (35 Fla.. 187, 17 South. Rep. 363).
