Polk, District Judge.

This is an action for personal injuries arising out of a collision between an automobile in which the plaintiff was *484riding with her husband and a road roller being used at night by the defendant in the construction of a highway in Dodge county, Nebraska, between Winslow and Uehling. From a verdict and judgment in favor of the plaintiff for $3,000 the defendant appeals.
