Plaintiff brought this action under section 376 of the Code of Civil Procedure to recover damages for the death of Mieczyslaw Wiezorek, his only child, a boy of six and a half years of age, who was run down and killed by defendant’s automobile. The judgment entered upon the verdict was for ten thousand dollars. A witness, who had been driving an automobile ahead of appellant’s on the occasion of the accident, saw deceased, as he started to cross Ninth Street, in the city of Los Angeles, pause in front of a truck standing alongside of the curb to let the witness drive by.
