OPINION

MICHAEL H. SCHNEIDER, Chief Justice.

The Court considered the appellee’s motion for rehearing en banc. A majority of the justices of the Court voted to deny the motion. However, the panel withdraws its prior opinion, and issue this opinion in its place.

This is an attorney disciplinary action that resulted in the disbarment of appellant, Jack Edward Love. The controlling issue in this case is whether the disciplinary action against Love was brought under article X of the former State Bar Rules or the current Texas Rules of Disciplinary Procedure.
